NOTICE: This Privacy Notice is effective as of the date below. The Silverado Resort has undergone a change of ownership resulting in the transfer of operations of the Property and this Website to KSL Resorts, Inc. Personal information collected by the former owner and operator of the Property and this Website, Wyndham Hotel Group, LLC (“WHG”), may still be under their control. Inquiries about the collection and use of your personal data collected prior to the Effective Date should be directed to WHG.


I. Introduction.
Welcome to Silverado Resorts. It is our goal to make your interactions with the Silverado Resort (the “Property”) as comfortable as possible. One of the ways that we work towards this goal is by respecting your privacy as you explore not only the Property but also this website, our social media pages, and our applications which display this Privacy Notice.
This Privacy Notice applies to information collected by us whether online through our website at , in person when you provide information at the Property, or from third parties to whom you have provided information. We process your personal information in order to ensure that your experience with us is unsurpassed—whether it be making a reservation, booking an appointment, dining at our restaurants, or any other experience you may have with us.
By becoming a guest at our property or otherwise interacting with us, you understand and agree that we may collect, use, disclose, and share your personal information in accordance with this Privacy Notice.
The Property and this website are operated by KSL Resorts, Inc. When referring to “us,” “our,” or “we,” we mean KSL Resorts, Inc. This Privacy Notice does not apply to any third party, including through any application or content (including advertising) that may be accessible from our website or any third party from or to whom we gather or share personal information. This Privacy Notice does not apply to any interactions with KSL Resorts, Inc. outside of its role as the operator of the Property.

The Facebook pixel is a snippet of code that sends data back to Facebook about people who visit this site and allows the site operator to later target them with ads on Facebook. For example, if a guest or other person at our property requires medical or emergency assistance, we may collect and share information about individuals in order to assist with the situation. In limited cases, we may also collect information relating to the credit of customers and share it with credit reporting agencies or other parties with whom we contract to evaluate creditworthiness. If you enter into a contest, sweepstakes, or other promotion, we may collect personal information from you in order to administer the event. In doing so, we may disclose your information to our co-sponsors, service providers, and other third parties in accordance with the event’s purpose and as described in the official rules or terms.


III. Our Operational and Commercial Purposes
As part of operating a first-class luxury resort, we undertake a multitude of operations which require the processing of personal information. For example, our business purposes include: (1) accepting, coordinating, managing, and processing hotel and resort accommodations; (2) facilitating purchase transactions for goods and services; (3) providing top-level customer support, accommodations, and personalized services and amenities; (4) engaging in quality control in order to improve our offerings to you; (5) administer membership, rewards, and other incentive programs, conduct marketing and sales promotions; (6) engage in content based or interest-based advertising, (7) ensuring the safety and security of our guests, our staff, and all other persons visiting our online and real properties; (8) preventing prevent, detect, and investigate fraud, cyber incidents, or other illegal activity; (9) communicating with you and others in relation to your use of our services, including providing legal updates; (10) administering our record-keeping for legal, tax, and operational purposes; (11) exploring new and unique ways to provide products and services; and (12) doing our best to fulfill your requests. Our commercial purposes are to advance our commercial interests, including for advertising and marketing.

We may share your personal information among KSL Resorts’ affiliates, owners and operators of our managed hotels, and KSL Capital Partners, LLC and its affiliated companies. We also will disclose your personal information to any agents our third parties to whom you authorize us to disclose it.
We may disclose personal information in the following circumstances: (1) in order to comply with an applicable federal, state, or local law; (2) in order to comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities; (3) to cooperate with law enforcement agencies concerning conduct or activity that web reasonably and in good faith believes may violate federal, state, or local law; (4) to exercise and defend legal claims; (5) when such disclosure is pursuant necessary to protect the rights and freedoms of other individuals; (6) as part of a merger, acquisition, bankruptcy, or other transaction in which the third party assumes control of all or part of the Property or KSL, Resorts, Inc., and (7) in any other manner permitted by law, including engaging in protected speech.

While we do not target individuals in the EU or other jurisdictions outside of the United States, we are aware that individuals from outside the EU may interact with us and inquire about the adequacy of our data protection. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 41 of the GDPR. SILVERADO FORTINET CHAMPIONSHIP TICKET GIVEAWAY OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

  1. Eligibility:Giveaway (the “Giveaway”) is open only to those who sign up at the online Giveaway page and who are 21 years of age as of the date of entry. The Giveaway is open only to legal residents of the fifty (50) United States and District of Columbia, and is void where prohibited by law. Employees of Silverado Resort and Spa (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Giveaway.   2. Agreement to Rules:By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. How to Enter:The Giveaway must be entered by following the @SilveradoResort Instagram account, and tagging one individual Instagram users on the Giveaway entry post by April 10, 2022 at 11:59PM PST. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Silverado Resort and Spa. You may enter only once and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Silverado Resort and Spa. By participating in the Giveaway, you acknowledge that the Giveaway is in no way sponsored, endorsed or administered by or associated with Instagram.
  5. Submission Terms. By entering this Giveaway, you represent and warrant that your does not violate any third party’s proprietary or intellectual property rights. If your submission infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of Sponsor. If the content of your submission is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. In addition, you agree to indemnify, defend, and hold harmless Sponsor from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Sponsor may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
  6. Prizes: Winners will receive two (2) tickets to the 2022 Fortinet Championship hosted at Silverado Resort in Spa September 14-18, 2022.

Total ARV of all prizes: $150. Sponsor, in its sole discretion, reserves the right to substitute prize(s) of equal or greater value if an advertised prize become unavailable. Sponsor’s determinations regarding the awarding of prizes is final. No prize substitutions except as provided herein. Prizes are not transferable and may not be given, bartered, sold, or exchanged for cash or another prize, except at Sponsor’s sole discretion due to prize unavailability for any reason and then only for a prize of equal or greater value. Any and all other costs and expenses associated with prize acceptance and use not specifically stated within these Official Rules as being provided, are the sole responsibility of the winner, including, without limitation, all federal, state, and local taxes, additional transportation and meals, luggage fees, gratuities, and souvenirs. For any prize over $600 in value, the potential winner will be required to complete and sign an IRS Form W-9. In compliance with US IRS regulations, Sponsor will send a Form 1099-MISC to any winner receiving a prize valued in excess of $600 (USD), which requires disclosure to Sponsor of winner’s social security number. Winner remains solely responsible for paying all federal and other taxes in accordance with the laws that apply in winner’s state of residence. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected.

The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Terms: Silverado Resort and Spa reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such case, Silverado Resort and Spa may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Silverado Resort and Spa. Silverado Resort and Spa has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Giveaway rules; or the use of bots, macros or scripts or other technical means for entering.

Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, Silverado Resort and Spa reserves the right to seek damages from any such person to the fullest extent permitted by law.

Limitation of Liability: By entering you agree to release and hold harmless Silverado Resort and Spa and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
  2. Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway), and participant further waives all rights to have damages multiplied or increased.

Without limiting the generality of the foregoing, Sponsor may retain for a reasonable period of time, personal information submitted in order to enable it to send that participant any prize that they have won and to verify that these Official Rules have been complied with, and for accounting purposes.  This data may be passed to a third party to enable such third party to fulfill any necessary requirements relating to the award of a prize. Any other use of personal information will be in accordance with, and subject to, the Privacy Policy.  Participant may have the opportunity to opt in to receive emails or other communications from third parties. In the event that participant opts in to any available opportunities to receive information from a third party, that may or may not be associated with this Giveaway, participant understands and acknowledges that his/her information will be provided to such third party and may be used by the third party as set forth in the third party’s privacy policy. Any available opt-in opportunities are not required to enter the Promotion, and opting in will not improve your chances of winning.
